Judge, Court of Criminal Appeals, Place 3
Okey Anyiam
Democrat
Qualifications
What training, experience, and characteristics qualify you for this position?
I have practiced Criminal Law for 28 years and handled several thousand criminal cases. My goal has been to see that the due process rights of defendants are upheld, and justice is truly served.
Ethics
How will you ensure your rulings remain impartial and free from both political pressure and the interests of your campaign donors?
I will abide by the Judicial Oath, just as I have upheld my Attorney Oath. I will be impartial. My rulings will be based on the law, independent of any outside influences.
Equity
What barriers prevent Texans from accessing the court system, and what can courts do to reduce those barriers?
Texans who live far from the courthouse will benefit from more satellite offices to meet with counsel, and virtual court proceeding where appropriate. A messaging system to keep abreast of court settings and requiring a court appearance only on disposition settings will reduce bond forfeitures. Lowering the threshold to qualify for court appointed counsel will help lower income earners.
Precedent
What factors should the Court of Criminal Appeals consider when deciding whether to change a past court ruling?
New evidence such as scientific evidence that fundamentally changes the basis of the past ruling may be considered. Legislative changes may also be considered. A persuasive recantation of the evidentiary testimony that formed the basis of a past ruling may also be considered. A past ruling may also be changed where it no longer serves the needs of today.
Philosophy
What is your judicial philosophy?
I believe in equal access to justice for all, upholding the law and following its clear intent, without legislating from the bench.
